THE PREYER SUBSTITUTE ALLOWS THE EPA TO REPRESENT ITSELF IN CIVIL ACTIONS IN COURTS OF ORIGINAL JURISDICTION, BUT RESERVES JUSTICE DEPARTMENT CONTROL OF APPELLATE LITIGATION. THE BUTLER AMENDMENT WOULD HAVE RETAINED JUSTICE DEPARTMENT CONTROL OVER ALL EPA LITIGATION.
