TO AMEND THE WAXMAN AMENDMENT TO H.R. 3605, A BILL AMENDING THE FEDERAL FOOD, DRUG, AND COSMETIC ACT TO AUTHORIZE AN ABBREVIATED NEW DRUG APPLICATION UNDER SECTION 505 OF THAT ACT FOR GENERIC NEW DRUGS EQUIVALENT TO APPROVED NEW DRUGS. THE WAXMAN AMENDMENT PROVIDES NEW LANGUAGE FOR THE ABBREVIATED NEW DRUG APPLICATIONS PROVISIONS. THE SHAW AMENDMENT PRECLUDES FDA APPROVAL OF GENERIC SUBSTITUTES UNTIL 18 MONTHS, INSTEAD OF 30 MONTHS, AFTER THE GENERIC DRUG APPLICATION IN CASES WHERE PATENT LITIGATION IS UNDERWAY.
